Arizona solar cancellation rights

Not less than 3 business days after signing AND before the system is installed — a statutory right of rescission that must be a separately-acknowledged provision in every residential solar financing, sale, or lease agreement (A.R.S. § 44-1763). FTC Cooling-Off Rule (16 CFR Part 429) also applies.

The law

  • A.R.S. § 44-1763 (distributed energy generation system sale/lease agreement requirements: signed and dated, ≥10-point type, 3-business-day rescission right, equipment description/warranty disclosures; blank-space agreements voidable by buyer until installation)
  • A.R.S. § 33-439 (HOA solar restrictions void)
  • FTC Cooling-Off Rule, 16 CFR Part 429

Contract notes

Statute expressly covers financing, sale, AND lease of distributed energy generation systems. Agreements with material blank spaces at signing are voidable at the buyer's option until installation. A 2026 bill (SB 1419) amending § 44-1763 keeps the 3-business-day floor.

Enforcement watch: No AG consumer-enforcement action on residential solar sales located for 2024–2026. (AG Kris Mayes co-led the Oct 2025 multistate suit against EPA over Solar for All termination — a federal-funding dispute, not a residential-sales enforcement action.)
