Georgia solar cancellation rights
30 BUSINESS DAYS for qualifying door-to-door sales under the Georgia Door-to-Door Sales Act (SB 149, Act 263, signed May 3, 2023, eff. July 1, 2023): buyer has until midnight of the 30th business day to cancel a sale solicited in person and consummated away from the seller's place of business involving payments of $10,000+ with a lease/financing term over 5 years. Note Georgia's old administrative cooling-off rule (Ga. Comp. R. & Regs. 122-3-.01) was REPEALED in 2016 — non-qualifying door-to-door sales rely on the FTC Cooling-Off Rule (16 CFR Part 429, 3 business days, ≥$25).
The law
- Ga. SB 149 / Act 263 (2023), Georgia Door-to-Door Sales Act (30-business-day cancellation for qualifying door-to-door sales of $10,000+ financed over 5+ years)
- O.C.G.A. Title 10 Fair Business Practices Act (general deceptive-practices enforcement)
- FTC Cooling-Off Rule, 16 CFR Part 429
Contract notes
Third-party solar power purchase agreements were authorized by the 2015 Solar Energy Procurement Agreements Act (HB 57). A 2024 law (reported by Kilpatrick Townsend) requires financial assurance for decommissioning of utility-scale solar power facility agreements — applies to land leases, not residential rooftop contracts. The 30-business-day door-to-door right applies only where the transaction meets the statute's definition (in-person solicitation + agreement away from seller's place of business + payments of $10,000 or more + lease/financing term over 5 years — verify exact final code sections with counsel; most long-term financed residential solar sales qualify, but cash sales under $10k likely do not).
