Contract notes

Third-party solar LEASING was legalized July 1, 2024 by HB 1062/SB 271. In 2026 the legislature passed the Solar Consumer Protection Act (HB 1439 Del. Shin / SB 823 Sen. Bagby): adds Va. Code 54.1-1117.1 requiring uniform contract provisions and disclosures for residential solar SALE, LEASE, LOAN, or PPA agreements (system specs, costs, financing options, cancellation rights), civil penalty up to $2,500 per willful violation, and Board for Contractors regulations by Jan 1, 2027; the act's operative provisions take effect JAN 1, 2027. STATUS IN FLUX: bill was enrolled (passed both houses) as of April 2026; governor's final signature not independently confirmed in this research — verify before relying.

Enforcement watch: Feb 6, 2026: the Commonwealth (VA AG's office) filed suit in federal court (Case 0:26-cv-01146, complaint posted at oag.state.va.us) against solar finance companies alleging hidden dealer/loan fees of 15.5-16% of the loan amount (thousands of dollars, often $10,000+, rolled into principal and understated APRs) and deceptive savings claims; claims under the federal Consumer Financial Protection Act (12 U.S.C. 5536) and the Virginia Consumer Protection Act (Va. Code 59.1-200). A secondary summary describes this as a suit against six solar finance companies. VA also joined the 2023 multistate Pink Energy lender letter.
